CONTRARY TO MANY INSURANCE COMPANY'S POSITION, COMPREHENSIVE GENERAL LIABILITY (CGL) INSURANCE DOES COVER ENVIRONMENTAL DAMAGE

  • Understanding CGL insurance - what it covers and what it does not - will help a policyholder collect insurance for environmental and pollution damage claims.  Other insurance policies may provide insurance coverage for part or all of a policyholder's environmental liabilities, but CGL insurance policies historically have been one of the broadest and most commonly used insurance policies for covering all of the risks faced by businesses, including the risk of environmental and pollution liability.

INSURANCE COVERAGE FOR ENVIRONMENTAL LIABILITIES

  • Businesses operating in the U.S. have faced significant and evolving risks relating to environmental hazards for several decades. Insurance coverage can help with the costs of defending and paying environmental claims.
  • Environmental claims may seek to recover millions of dollars either for alleged contamination from operations over decades or from new risks arising from Environmental Protection Agency (EPA) or other agency enforcement actions that address soil, air or water pollution. Insurance policies can be a critical asset to protect against the increasingly expensive costs of defending against, those claims and paying any resulting settlements or judgments.

A POSITIVE ENVIRONMENTAL PERFORMANCE CULTURE INCLUDES STRATEGIC VISION AND MUST RELATE TO A LARGER STRATEGIC GOAL. AT ENVIRONMENTAL STRATEGIC GROUP, WE HAVE IDENTIFIED HOW WE CAN HELP YOU PRIORITIZE CHANGING YOUR COMPANY OR ORGANIZATION'S ENVIRONMENTAL PERFORMANCE CULTURE. HERE ARE A FEW TIPS THAT WILL DRIVE THAT CHANGE:

  • Ensure the establishment of strategic environmental performance goals… Driven by senior management
  • Ensure education and training is embedded in the company or organization’s environmental performance activities
  • Develop and reinforce incentive programs that reward proactive environmental performance deeds and recognize problem-solvers
  • Ensure that environmental performance is built-in to all activities and not simply be an add-on
  • Make sure the signs of a positive environmental performance culture are obvious… If questions have to be asked, then it’s not there.
  • Make sure environmental performance is represented around the senior management table otherwise your environmental performance effort could be seen as flowery prose by regulators and some stakeholders.
